Fair Competition Tribunal (FCT) Vacancies September 2024

The Government of Tanzania, through Act No. 8 of 2003 (The Fair Competition Act), established the Fair Competition Tribunal (FCT), an independent, specialized quasi-judicial body. The Tribunal consists of cross-disciplinary experts in law, economics, commerce, and public administration. Its core mandate is to hear and determine appeals involving competition and economic regulatory issues. Specifically, the Tribunal addresses appeals arising from the decisions and orders of:

  • Fair Competition Commission (FCC)
  • Energy and Water Utilities Regulatory Authority (EWURA)
  • Land Transport Regulatory Authority (LATRA)
  • Tanzania Communications Regulatory Authority (TCRA)
  • Tanzania Civil Aviation Authority (TCAA)
  • Petroleum Upstream Regulatory Authority (PURA)

Additionally, the Tribunal handles appeals related to counterfeit products from decisions made by the Chief Inspector of the Mercantile Marks.

Tribunal Composition

The Tribunal is composed of a Chairman and six Members, all of whom work on a part-time basis. These officials are appointed by the President of the United Republic of Tanzania:

  • The Chairman is appointed from among the Judges of the High Court after consultation with the Chief Justice.
  • The six Members are appointed following nominations by the Nomination Committee and consultation with the Attorney General.

The primary responsibility of the Chairman and the Members is to hear and determine appeals arising from the regulatory authorities mentioned earlier.

Expiry of Terms

The term of service for the current Members of the Tribunal (excluding the Chairman) expired on 16th June 2024, after a three-year tenure.

Applications Invited

In light of the above, applications are now invited from suitably qualified Tanzanians to fill the six vacant posts for Members of the Fair Competition Tribunal. Appointees will serve on a part-time basis for a period of three years.

Eligibility Criteria

Applicants must meet the following requirements:

  • A minimum of ten (10) years of experience in the fields of law, economics, commerce, industry, or public administration.
  • A Master’s Degree in the relevant field.
  • Knowledge of, or experience in, competition law and competition economics is an added advantage.
